Terms & Conditions

These Terms & Conditions govern your access to and use of the Schecker Business Systems website, software products, and related services (collectively, the “Services”). By using the Services you agree to these terms. If you do not agree, do not use the Services.

Schecker Business Systems designs, implements, and supports custom business systems, including productized systems such as Link — Sales Command Center and Customer Capture Co. The specific scope, deliverables, fees, and term of any engagement are governed by a separate written services agreement or order form, which controls in the event of a conflict with these terms.

You are responsible for maintaining the confidentiality of account credentials and for all activity that occurs under your account.

You agree not to misuse the Services, including by attempting unauthorized access, interfering with normal operation, reverse engineering our software, reselling access without authorization, or using the Services to send unlawful, deceptive, or unsolicited communications.

You retain ownership of the data you provide to or process through the Services. You grant Schecker Business Systems a limited license to use that data solely to operate, support, and improve the Services provided to you.

You are responsible for ensuring you have all necessary rights and consents for any customer data, email addresses, or phone numbers you provide, and for complying with all applicable laws, including CAN-SPAM, TCPA, and applicable privacy regulations.

By providing a mobile phone number and opting in, you consent to receive text messages from Schecker Business Systems related to the Services, including system alerts, appointment and scheduling notifications, and responses to your inquiries. Consent to receive messages is not a condition of purchase.

Message frequency varies.

Message and data rates may apply.

Reply STOP to any message to unsubscribe. After replying STOP, you will receive one confirmation message and no further messages unless you opt in again.

Supported carriers may vary. Carriers are not liable for delayed or undelivered messages.

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent are never shared with third parties.

Link SMS Alerts are operational notifications sent by Schecker Business Systems.

Link SMS Alerts are intended for authorized users and employees of businesses that are Link customers.

Authorized business users may receive operational SMS alerts from Schecker Business Systems and Link related to estimate activity, sales follow-up, and other system events.

Consent to receive SMS messages is not a condition of purchase.

Carriers are not responsible for delayed or undelivered messages.

SMS messages are operational in nature and are not promotional marketing messages.

Fees, billing frequency, and payment terms are set out in the applicable services agreement or order form. Unless stated otherwise, invoices are due within thirty (30) days of receipt, and late amounts may accrue interest at the lesser of 1.5% per month or the maximum permitted by law.

Schecker Business Systems retains all right, title, and interest in its software, systems, templates, methodologies, and related intellectual property, including improvements developed during an engagement. Subject to payment of all applicable fees, you receive a non-exclusive, non-transferable license to use the delivered system for your internal business purposes.

Each party agrees to protect the other's confidential information with at least the same care it uses for its own, and to use it only for purposes of the engagement. This obligation survives termination.

The Services may integrate with third-party platforms such as email providers, messaging providers, and CRMs. We are not responsible for the availability, performance, or policies of those third parties, and your use of them is governed by their own terms.

We will perform services in a professional and workmanlike manner. Except as expressly stated, the Services are provided “as is” without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

To the maximum extent permitted by law, Schecker Business Systems will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our total aggregate liability arising out of or relating to the Services will not exceed the amounts paid by you to Schecker Business Systems in the twelve (12) months preceding the event giving rise to the claim.

Either party may terminate an engagement as set out in the applicable services agreement. We may suspend or terminate access to the Services for material breach, non-payment, or activity that threatens the security or integrity of our systems. Upon termination, you remain responsible for fees incurred through the termination date.

We may update these Terms & Conditions from time to time. Continued use of the Services after an update constitutes acceptance of the revised terms.

These terms are governed by the laws of the state in which Schecker Business Systems is organized, without regard to conflict-of-law principles. The parties consent to exclusive jurisdiction and venue in the courts located in that state.
